Terms & Conditions for "Wild Pansy Coaching's Programs."

IN CONSIDERATION OF BEING ALLOWED TO PARTICIPATE IN VIRTUAL PROGRAMMING (THE "PROGRAM"), ORGANIZED BY WILD PANSY COACHING (W.P.C.), I (THE "PARTICIPANT) AGREE TO COMPY WITH ANY AND ALL RULES, REGULATIONS, TERMS AND CONDITIONS OF THE PROGRAM, INCLUDING BUT NOT LIMITED TO THE FOLLOWING:

Acknowledgment of Risk

In consideration of the risks while participating in the Program, I hereby, for myself, my heirs, executors, administrators, assigns, or personal representatives, knowingly and voluntarily enter into this waiver and release of liability and hereby waive any and all rights, claims or causes of action of any kind whatsoever arising out of my participation in the Prorgram, and do hereby release and forever discharge Wild Pansy Coaching, LLC ("W.P.C"), located at 1315 Spruce Street, Philadelphia, PA 19107, their affiliates, managers, members, agents, attorneys, staff, volunteers, heirs, representatives, predecessors, successors, and asignees (collectively, the "Released Parties"), for any physical of psychological injury, including but not limited to dmanages, economical, or emotional loss, that I may suffer as a direct result of my particpation in the aforementioned Program.

I undersatnd that W.P.C. does not provide mental health care, medical care, crisis services, or legal consultation. I undersatnd and ackowledge that the Program is not intended to serve as professional advice or treatment. I understand that I should only particpate in the Program if I am in stable psychological and emotional condition. If at any point during the Program I feel overwhelmed or in crisis, I agree to leave the Program and seek appropriate professional support. If I requre psychological support, medical assistance, or legal counsel, I agree to seek help from the appropriate professionals.

I AM VOLUNTARILY PARTICIPATING IN THE AFOREMENTIONED PROGRAM AND I'M PARTICPATING IN THE PROGRAM ENTIRELY AT MY OWN RISK. I AM AWARE OF TEH RISKS ASSOCIATED WITH PARTICIATPING IN THIS PROGRAM, WHICH MAY ICLUDE, BUT ARE NOT LIMITED TO PSYCHOLGICAL INJURY, SUFFERING, AND EMOTIONAL LOSS. I UNDERSTAND THAT THESE OUTCOMES MAY ARISE FROM MY OWN OR OTHERS' NEGLIGENCE OR THE CONDITIONS OF THE PROGRAM. NONETHELESS, I ASSUME ALL RELATED RISKS, BOTH KNOWN AND UNKNOWN TO ME, OF MY PARTICIPATION IN THIS PROGRAM.

Release & Waiver of Liability
I agree to indemnify and hold harmless W.P.C. against any and all claims, suits or actions of any kind whatsoever for liability, damages, compensation or otherwise brought by me or anyone on my behalf, including attorney’s fees and any related costs, if litigation arises pursuant to any claims made by me or by anyone else acting on my behalf. If W.P.C. incurs any of these types of expenses, I Agree to reimburse W.P.C..

I acknowledge that W.P.C. and their directors, officers, volunteers, representatives, and agents are not responsible for errors, omissions, acts, or failures to act of any party or entity conducting a specific event or activity on behalf of W.P.C.

I ACKNOWLEDGE THAT I HAVE CAREFULLY READ THIS “WAIVER AND RELEASE” AND FULLY UNDERSTAND THAT IT IS A RELEASE OF LIABILITY. I EXPRESSLY AGREE TO RELEASE AND DISCHARGE W.P.C. AND ALL OF ITS AFFILIATES, MANAGERS, MEMBERS, AGENTS, ATTORNEYS, STAFF, VOLUNTEERS, HEIRS, REPRESENTATIVES, PREDECESSORS, SUCCESSORS AND ASSIGNEES, FROM ANY AND ALL CLAIMS OR CAUSES OF ACTION AND I AGREE TO VOLUNTARILY GIVE UP OR WAIVE ANY RIGHT THAT I OTHERWISE HAVE TO BRING A LEGAL ACTION AGAINST W.P.C. FOR PERSONAL INJURY OR PROPERTY DAMAGE.

To the extent that statute or case law does not prohibit releases for negligence, this release is also for negligence on the part of W.P.C., its agents, and employees.

This Agreement was entered into at arm’s-length, without duress or coercion, and is to be interpreted as an Agreement between two parties of equal bargaining strength. Both the Participant and Wild Pansy Coaching agree that this Agreement is clear and unambiguous as to its terms, and that no other evidence will be used or admitted to alter or explain the terms of this Agreement, but that it will be interpreted based on the language in accordance with the purposes for which it is entered into.

In the event that any provision contained within this Release of Liability shall be deemed to be severable or invalid, or if any term, condition, phrase, or portion of this Agreement shall be determined to be unlawful or otherwise unenforceable, the remainder of this Agreement shall remain in full force and effect so long as the clause severed does not affect the intent of the parties. If a court should find that any provision of this Agreement to be invalid or unenforceable, but that by limiting said provision it would become valid and enforceable, then said provision shall be deemed to be written, construed and enforced as so limited.

By agreeing to these terms and conditions, I, the undersigned Participant, affirm that I am of the age of 18 years or older, and that I am freely entering into this Agreement. I certify that I have read this Agreement, that I fully understand its content, and that this release cannot be modified orally. I am aware that this is a release of liability and a contract and that I am agreeing to it of my own freewill.

Terms & Conditions
I acknowledge that if I violate any aspect of these Terms & Conditions or any other W.P.C. rules, I can be removed from the Program. I acknowledge the Program’s schedule and presenters are subject to change. I confirm that these Terms & Conditions supersede any and all previous, oral, or written promises, or agreements regarding the subject matter hereof (including any statements made on the Program website) and understand that this is the entire agreement between me and the Released Parties as to the subject matter hereof and cannot be modified or changed in any way except in a writing signed by an authorized representative of W.P.C.  I expressly agree that these Terms & Conditions are intended to be as broad and inclusive as is permitted by the laws of the State of Pennsylvania and that if a portion thereof is held invalid, it is agreed that the balance shall continue in full legal force and effect. I agree that by participating in the Program, my act of accepting these Terms & Conditions shall confirm that I have read and understood these Terms and Conditions and that I agree to all of its terms, to the same extent as if I read a paper copy of these Terms and Conditions and placed my signature on such paper copy with my own hand.
